Workplace Bullying Investigation and Prevention Measures
Attorney Chen Yesin was honored to accept the invitation of the Labor Affairs Bureau of Taichung City Government to deliver a 90-minute keynote presentation on August 12, 2026, from 9:00 AM to 10:30 AM. The talk addressed the topic of utmost concern to occupational safety and health (OSH) and HR professionals across local business entities: "Workplace Bullying Investigation and Prevention Measures."
According to Director Chiu and Section Chief Yu of the organizing Labor Inspection Office, the initial registration capacity was capped at 300 participants. Unexpectedly, it filled up immediately upon opening. Even after an emergency venue change and budget adjustment to expand the cap to 450 participants, it sold out quickly once again—vividly demonstrating the intense and unabated interest in this issue.
Today's session shared three primary insights:
All documentation generated throughout investigation procedures and final determinations stands a high probability of eventually undergoing rigorous review by regulatory authorities, civil court judges in labor tribunals, and administrative court judges (should a business contest an administrative penalty issued by labor inspection authorities).
Labor law is an expansive and highly specialized field—please prioritize lawyers professionally certified in labor law by the Taiwan Bar Association to handle these matters. Avoid hiring self-proclaimed "know-it-alls" who claim to speak on every topic under the sun—from outer space to human anatomy—or worse, non-lawyers. Remember that these legal documents stand a high chance of being subjected to strict judicial examination in court.
Strictly observe procedural rules, including statutory deadlines, panel composition ratios, and conflict-of-interest recusals. Throughout the investigation and handling process, always keep in mind that executing such rigorous procedures serves one ultimate purpose: producing the two most critical legal documents—the Investigation Report and the Determination of Findings Notice. The latter must explicitly detail the supporting facts and legal reasoning behind the verdict, notify the parties involved, and outline the methods and deadlines for filing an appeal for remedy. This is essentially an internal corporate version of a court judgment; without adequate professional expertise, it is virtually impossible to draft properly.
